Terms and Conditions of Service for Bligh Veterinary Services Centre
1. Acceptance of Terms
By utilizing the services provided by Bligh Veterinary Services Centre, clients agree to comply with and be bound by the terms and conditions outlined herein. These terms and conditions can be found at www.bvsc.sydney/terms-and-conditions/
2. Indemnification
The client agrees to indemnify, defend, and hold harmless Bligh Veterinary Services Centre, its veterinarians, staff, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:
(a) The client's breach of any terms and conditions outlined herein.(b) Any injury, illness, or harm caused by the client's animal to other animals, individuals, or property.(c) Any third-party claims arising from the client's failure to disclose relevant information about the animal's health, behavior, or any other material details.(d) Any claims or actions resulting from the client's failure to follow the veterinary clinic's recommendations or instructions for the care of the animal.
The client acknowledges and agrees that Bligh Veterinary Services Centre shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages resulting from the provision of veterinary services. The client agrees to act in good faith at all times.
3. Appointments and Cancellations
Clients are responsible for scheduling appointments in advance. A cancellation fee may be applicable for appointments cancelled within 24 hours of the appointment time, or for no-shows. Appointment cancellations must be confirmed by Bligh Veterinary Services Centre staff.
4. Emergency Services
Emergency veterinary services are available during specified hours. Clients cannot rely on the availability of Bligh Veterinary Services Centre to be available to admit or attend an emergency case. Whilst staff will take every care to prioritise emergencies, staff may not always be available. Clients must contact an emergency veterinarian if Bligh Veterinary Services Centre is uncontactable or is unable to admit or attend the emergency.
5. Fees and Payment
Clients are responsible for all fees associated with veterinary services. Payment is due at the time of service. Bligh Veterinary Services Centre accepts various payment methods, and details about fees will be provided upon request. Clients agree to pay all account keeping fees and overdue fees as specified in these terms and conditions including debt collection fees and legal fees incurred by Bligh Veterinary Services Centre and BG Vet Group Pty Ltd should payment not be made by the client by the due date as specified in the invoice or statement supplied to the client or sent to the client's contact details recorded in their profile. Clients understand that any change in ownership of an animal must be reported in writing to Bligh Veterinary Services Centre within seven days of the change in ownership. If an ownership change is not reported within seven days then the client will continue to be liable for fees and costs associated with veterinary treatment as per the ownership recorded on the horse's veterinary file until the change in ownership is reported. Invoices and statements will not be backdated more than seven days from the date of the reported ownership change. Overdue fees: Clients may be charged interest on account overdue by 30 days or more at a rate of 1.99% per month on the overdue amount compounded monthly. Account keeping fees: An account keeping fee of $12 per month may be applied to overdue accounts of 30 days or more. Debt recovery fees: Debt recovery fees of 15% (or the amount charged by the debt recovery business) are applied to an account as soon as the debt is referred to a debt recovery business for collection. Legal fees: Legal fees include all fees relating to recovery of an unpaid account (or unpaid accounts) through a legal firm, including but limites to court costs, lawyers fees, locating fees, sherriff fees and incidental costs. Debt Collection fees: Clients acknowledge that if the account is overdue, Bligh Veterinary Services Centre at its discretion, reserves the right to refer the account to a Mercantile Agency for collection and both parties agree to indemnify each other against all losses, damages, expenses and costs (on a full indemnity basis) that either party may sustain or incur as a result, whether directly or indirectly, of:(a) the other party breaching this Agreement;(b) the other party supplying any misleading, false or insufficient details;(c) any negligence or willful misconduct by the other party; and(d) any third party claim, except third party claims arising out of or relating to the other party’s negligence, or the other party’s breach of this Agreement.
6. Medical Records
All medical records of the animals treated at Bligh Veterinary Services Centre are property of the clinic. Medical records will be released as required by the laws of NSW and Australia. Reocrds will be retained by the clinic for a minimum of 5 years.
7. Consent for Treatment
Clients acknowledge that they are the legal owner or agent of the owner of the animal and give consent for all veterinary treatments deemed necessary by Bligh Veterinary Services Centre. The person responsible for the animal at the time of admission of the animal is responsible for payment of all services rendered.
8. Liability
Bligh Veterinary Services Centre will take reasonable care in providing veterinary services, but cannot be held responsible for unforeseen complications or outcomes.
9. Termination of Services
Bligh Veterinary Services Centre reserves the right to refuse or terminate services if deemed necessary for the well-being of the animal or for other reasons at the discretion of the veterinary staff.
10. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of Australia and New South Wales.
11. Changes to Terms
Bligh Veterinary Services Centre reserves the right to modify these terms and conditions at any time without warning or notice. Definitions 'client' means a person who has engaged the services of Bligh Veterinary Services Centre or who owns an animal or part of an animal that is presented to Bligh Veterinary Services Centre. 'clinic' means the veterinary clinic owned and operated by Bligh Veterinary Services Centre. 'Bligh Veterinary Services Centre' means Bligh Veterinary Services Centre Pty Ltd ABN 31647978532
